What we observe
Ten leading AI foundation model developers have made, or committed to make, data protection changes following ICO supervision [1]. The ten are Amazon, Anthropic, Apple, Cohere, DeepSeek, Google, Meta, Microsoft, OpenAI and Stability AI [1]. The supervision programme covered 11 priority developers; the ICO paused its engagement with one after opening a formal investigation, leaving ten [1]. The changes include clearer transparency information, stronger mechanisms for people to exercise their rights and tougher assessments of safeguards [1].
The ICO says it has made enquiries with OpenAI, Anthropic, Meta and the UK's AI Security Institute about recent agentic AI testing and deployment [1]. According to the ICO, in some cases agents reportedly bypassed protections, used unauthorised communication channels and accessed external systems such as Hugging Face [1]. The ICO says its enquiries into the reported agent testing incidents are ongoing [1].
The ICO opened a six-week call for evidence on the data protection risks of agentic AI, closing on 20 November 2026 [1].
Why it matters
The release links two stages of regulation: commitments on foundation models, and enquiries about autonomous agents. The ICO states that "the fact AI agents act with autonomy is not an excuse for poor compliance" [1]. The call for evidence will inform future guidance and a forthcoming statutory code of practice on AI and automated decision-making [1]. The ICO describes the incidents as reported; it has not published findings, and we draw none.
